Terms & Conditions

These Terms and Conditions ("Agreement") govern the use of services provided by Harmony Tree Removal, LLC, a tree service company located in Cedar Springs, Michigan. By using our services, you "Customer", agree to comply with and be bound by the terms outlined below.
 

1. Services Provided

We offer a variety of tree-related services, including but not limited to:

  • Tree trimming and pruning

  • Tree removal

  • Stump grinding

  • Tree planting

  • Emergency tree services

  • Land clearing

Specific details about services requested will be outlined in the service agreement prior to beginning work.

2. Pricing and Payment

  • Estimates: All prices are based on an initial assessment and may vary depending on the scope of work, site conditions, and specific customer requests.

  • Payment: Payments for tree services are due upon completion of the work unless otherwise agreed. Accepted payment methods include cash, credit cards and checks.

  • Late Fees: A late fee of 2.5% will be charged for payments not received within 10 days after the invoice date.

  • Additional Charges: If the scope of work changes after the initial estimate, we will provide an updated estimate, and additional charges may apply.

3. Customer Responsibilities

  • Access to Property: The customer must ensure that the area around the trees and any other relevant areas are accessible. This includes removing vehicles, debris, or any other obstructions that may impede our workers or equipment.

  • Permits: It is the customer’s responsibility to obtain any necessary permits for tree removal, trimming, or other services as required by local or state laws. We can assist in determining if permits are required.

  • Damage: The customer is responsible for ensuring that no structures, utilities, or other property will be damaged during the service. Any damage caused due to customer error, such as improper tree placement or unmarked underground utilities, is not the responsibility of Harmony Tree Removal, LLC.

4. Worksite Safety

  • We adhere to industry-standard safety practices, but the customer must ensure that all children, pets, and other persons remain at a safe distance from the worksite at all times.

  • If, at any time, the worksite becomes unsafe due to external factors (e.g., weather conditions, hazardous material exposure), work may be halted until conditions improve, and additional charges may apply if work is delayed or rescheduled.

5. Warranty and Limitations of Liability

  • Satisfaction Guarantee: We strive to provide high-quality tree services, and we offer a limited warranty on all work performed. If you are unsatisfied with the work, please contact us within 2 days, and we will work to remedy the issue. Certain limitations apply, and the warranty does not cover damage caused by natural disasters, accidents, or neglect.

  • Liability: Harmony Tree Removal, LLC is not liable for any damage to underground utilities (e.g., irrigation systems, water lines, septic systems) unless specifically noted in the work order. We are also not responsible for any damage caused by weather conditions such as storms or high winds after the service is completed.

  • Indemnification: The customer agrees to indemnify and hold harmless Harmony Tree Removal, LLC, its employees, and agents from any and all claims, damages, or liabilities arising from the customer's property, actions, or instructions.

6. Cancellation and Rescheduling

  • Cancellations: If you need to cancel or reschedule your service, please provide at least 48 hours notice. Failure to do so may result in a cancellation fee of 2% of the quoted subtotal.

  • Weather-Related Delays: If services are delayed or rescheduled due to weather conditions, we will notify you as soon as possible and make arrangements to complete the work at the earliest available opportunity.

7. Force Majeure

Harmony Tree Removal, LLC will not be held liable for any delays or failures to perform services caused by events beyond our control, including but not limited to natural disasters, labor strikes, equipment malfunctions, or government actions.

8. Termination

Either party may terminate this Agreement at any time by providing written notice. In the event of termination by the customer before the completion of the services, the customer will be responsible for paying for any services or related costs rendered up until the point of termination.

9. Dispute Resolution

In the event of a dispute arising from these Terms and Conditions or the services provided, both parties agree to attempt to resolve the matter through informal negotiations. If these efforts fail, the dispute will be resolved through binding arbitration in Kent County, Michigan, under the rules of the American Arbitration Association.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan, without regard to its conflict of law principles.

11. Miscellaneous

  • Amendments: Harmony Tree Removal, LLC reserves the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the website or otherwise notifying the customer.

  • Entire Agreement: This Agreement constitutes the entire understanding between the customer and Harmony Tree Removal, LLC regarding the tree services provided and supersedes any prior agreements or understandings.
